"Plaintiffs, Ed. Thys and Albert K. Miller, copartners under the firm name of Thys & Miller, instituted this action against Wilfred E. and Lucy Rivard, as defendants, asking for judgment for royalties alleged to be due under a written agreement, signed by plaintiffs and defendant Wilfred E. Rivard (who will hereinafter be referred to as though he were the sole party defendant in this action). Plaintiffs also asked for an accounting, for an attorney's fee, and for general relief."
